How long does it take to remove a registered agent in NY?
By Sandeep ArnejaUpdated
The short answer
The New York Department of State publishes no standard time for removing a registered agent from an LLC's record.
By our count of New York DOS open data read on October 26, 2026, of the 467 Certificates of Change that revoked a New York LLC's registered agent from January 2 to October 13, 2026, 239 (51.2%) show an "Approved Date" 3 days or less after their "Date Filed", and 36 (7.7%) show one more than 30 days after it. These are past records, not a promise.
- The State's filing. The Department of State processes each certificate on its own schedule, and the dates above are its own records of past filings.
- The change on the record. In the same open data, every one of those 467 revocations carries an effective date equal to its filing date, by our count. The thirty days in LLC Law §302(e) run from an agent's resignation, not from a revocation.
- Your contract with the registered agent company. When the agent company treats its service as ended is set by that company's own terms.
Remove Registered Agent files electronically through its operator's service company account with the Department of State: the certificate goes into the Department's system when it is submitted, dated that day, with nothing to print, mail or scan. Of the 12 Certificates of Change our operator emailed to the Department of State from June 15 to July 1, 2026, 11 were dated the day they were sent or the next business day; a mailed one is dated no earlier than the day the mail reaches the Department. If the State asks for a correction, Remove Registered Agent makes the correction and resubmits the certificate at no charge. The Certificate of Change accepted by the State, or your full $100 back.
Our operator's own filings show what each route has meant in practice. Of the 100 Certificates of Change our operator filed from January 12 to October 29, 2026, the 29 uploaded through eCorp's E-Submission, the route every certificate an LLC signs takes, had a median of under 1 day from filing to the State's response, and the 23 sent by mail a median of 7.2 days from mailing. These are past records, not a promise.
This guide takes each clock in turn: the dates in the State's own records, when a revocation shows as effective, what the record shows when it is done, a paid faster route, and the agent company's side.
How long does the State take to remove a registered agent?
By our count of DOS data, 7.7% of 2026 LLC revocations were approved more than 30 days after filing.
The data is the Department of State's Corporations and Other Entities: All Filings (opens in a new tab) data set on data.ny.gov, which we read on October 26, 2026; its rows were last updated on October 20, 2026. It gives each filing a "Date Filed" and an "Approved Date". In the data set's own words, the first is "The date the document was filed by Department of State" and the second is "Date the document was approved by the Department of State for filing".
By our count of this open data, 22,845 Certificates of Change were filed for New York LLCs and PLLCs from January 1 to October 19, 2026, and 467 of those filed from January 2 to October 13 revoked a registered agent: their entries in the companion address data set (opens in a new tab) read "REGISTERED AGENT REVOKED". The table counts the days from one date to the other.

Key fact
These are past records, not a promise: the Department of State publishes no standard processing time, and it processes each certificate on its own schedule.
The data holds the dates the Department of State recorded. It does not show when a certificate was sent, or when its filing receipt reached the filer, and the data set's notes do not say whether "Date Filed" is the day the Department received a document.
What the State checks before it files a certificate
New York's LLC Law gives the Department of State a narrow review of what it files.
Under LLC Law §209 (opens in a new tab), a certificate that "complies as to form with the requirements of law" and whose fee "has been paid" "shall be filed and indexed by the department of state". The same section says "The department of state shall not review such articles or certificates for legal sufficiency; its review shall be limited to determining that the form has been completed." (LLC Law §209).

How the certificate reaches the State changes the wait
Our operator's eCorp uploads were answered in a median of under 1 day; its mailed certificates, 7.2 days from mailing.
The open data above does not show when a certificate was sent. The Department of State has told our operator that mailed and emailed filings are scanned in by hand before a reviewer sees them, and that an emailed filing gets no work order confirmation and no status.
Remove Registered Agent files each signed certificate electronically through the E-Submission upload of eCorp, the Department of State's online filing system, under its operator's service company account; filers without a service company account email or mail the Certificate of Change. The Department of State reached out to our operator in June 2026 because of its filing volume; our operator applied, and the Department approved the application and set up its service company account.
| You, filing it yourself | Remove Registered Agent | |
|---|---|---|
| Your part | Every step: the record, choosing the statements, the form and its cover sheet, the fee and the sending | Confirm the details by email, choose any new address and sign |
| How the certificate reaches the State | By email or mail | Electronically, through eCorp's E-Submission upload, with a work order number when it is submitted |
| Our operator's past filings by that route | Mailed: a median of 7.2 days from mailing (23 filings); emailed: a median of 4.2 days from emailing (12 filings) | Uploaded through eCorp's E-Submission: a median of under 1 day from filing to the State's response (29 filings) |
| A correction the State asks for | You fix it and send it again | Remove Registered Agent makes the correction and resubmits the certificate at no charge |
For an owner filing it by hand, it comes to at least 10 hours of work, with everything right the first time; our operator timed it. Most of those hours go to steps a quick estimate leaves out: reading the LLC Law to choose the statements, checking with the agent company, calling the Department of State and waiting for its answer, and checking everything again before mailing. In our operator's experience, one small mistake on the form brings a correction letter and a resubmission. Remove Registered Agent applies LLC Law §211-A (opens in a new tab), §302 (opens in a new tab) and §301 (opens in a new tab) to your LLC's live record: which statements it calls for, and whether the address must be replaced. If the State asks for a correction, Remove Registered Agent makes the correction and resubmits the certificate at no charge. The Certificate of Change accepted by the State, or your full $100 back. The DOS-1359-f guide lists where the hours go.

How long until a registered agent removal is final?
No text in LLC Law §211-A or §302 sets a waiting period after an LLC revokes its registered agent.
What the law says
In New York's LLC Law, the thirty days apply to a resignation: §302(e) (opens in a new tab) says "The designation of a registered agent shall terminate thirty days after the filing with the department of state of the certificate of resignation."

By our count of New York DOS open data read on October 26, 2026, every one of the 22,845 Certificates of Change filed for New York LLCs and PLLCs from January 1 to October 19, 2026 carries an "Eff Date" (in the data set's words, "Effective Date of the document filed") equal to its "Date Filed"; so do all 467 that revoked a registered agent. The "Approved Date" of the same certificate can come days or weeks after both.
For a corporation, not an LLC, the rule is different: BCL §305(d) (opens in a new tab) says "The designation of a registered agent shall terminate thirty days after the filing by the department of state of a certificate of resignation or a certificate containing a revocation or change of the designation, whichever is filed earlier."

What the law says
New York law does not require an LLC to have a registered agent: an LLC "may designate" one "In addition to the designation of the secretary of state" (LLC Law §302(a)). Every New York LLC already has an agent for service of process: the Secretary of State, named in its articles of organization.

How do you know the registered agent was removed?
The State's live record shows a revocation in its registered agent entry, and its filing history lists the certificate.
On all 14 records we read on October 23, 2026 whose agent a Certificate of Change had revoked, the State's live record showed "Registered Agent Revoked" under "Registered Agent Name and Address", with a blank agent address, and the filing history listed "REGISTERED AGENT_REVOKE AUTHORITY OF REGISTERED AGENT". On DOS Public Inquiry, the same entry prints in capitals: under "Registered Agent Name and Address", it reads "Name: REGISTERED AGENT REVOKED". The State's filing receipt confirms that the Certificate of Change was filed. When Remove Registered Agent files the certificate, it checks the LLC's live record afterwards and sends the State's filing receipt and what changed.

Revoking a New York LLC's registered agent does not move its service of process address: the Secretary of State keeps mailing a copy of any process against the LLC to the address on file until a filing changes it. One Certificate of Change, form DOS-1359-f, can revoke the registered agent and replace the service of process address on the same filing.
Process is the papers served to start or carry on a legal action, such as a summons; the service of process address is the post office address to which the Secretary of State mails a copy of any process against the LLC served on it.

Is there a faster way to remove a registered agent?
The Department of State offers expedited handling for an extra, non-refundable fee, and its page says when the clock starts.
The Department of State's expedited handling page (opens in a new tab) lists three windows, from "Within 24 hours of the request" to "Within 2 hours of receipt of the request", each for an "additional, non-refundable fee" and each with its own conditions on that page (read October 26, 2026).
The same page (opens in a new tab) says "The time for processing your request begins when the request is received by the appropriate unit of the Division of Corporations." and "For documents submitted for filing, such documents are considered processed when they are either filed or rejected as deficient."
The agent company's contract runs on its own terms
An agent company's renewal date and cancel rules come from its contract, not from the State's record.
An agent company's bill follows its contract with the LLC, not the State's record. When a renewal falls due, how and by when a cancel request must reach the company, and whether any refund applies are addressed under each company's published terms, where it publishes them.
Two separate steps
Step 1
Your New York record
With: The New York Department of State
One Certificate of Change can take the agent company off the record and, where needed, replace the service of process address. The LLC signs it, and Remove Registered Agent files it.
The State's filing receipt confirms the filingStep 2
Your contract with the agent company
With: The agent company
The LLC cancels or does not renew the contract, under that company's own terms.
Cancelling the contract alone does not change the State's record
Our guide on cancelling a registered agent service quotes what agent companies' published terms ask when you leave, dated and linked. Whether the agent company's billing ends depends on its own terms.

Why answers about the timing differ
Some answers online borrow a figure or a rule that is not New York's for an LLC.
- Not 30 to 50 days. No Department of State page we read on October 26, 2026 gives that figure, or any standard processing time for a routine filing.
- Not a thirty-day wait after a revocation. In LLC Law, §302(e)'s thirty days run from an agent's resignation; the thirty-day rule that also counts from a revocation is the corporation rule above.
- Not by mail only. The Department of State's updates page lists email and mail for filings, as the filing guide sets out, and a service company files electronically through eCorp.
What Remove Registered Agent does about timing
Remove Registered Agent takes the hours off the LLC's plate and files each certificate electronically under its operator's service company account.
It files through the Department of State's E-Submission upload, checks the live record afterwards, and sends the LLC the State's filing receipt and what changed on the record. The New York Department of State processes each certificate on its own schedule, so any time Remove Registered Agent gives is an estimate from past filings, not a promise. Its price does not include the Department of State's optional expedite fees.
What it takes off the LLC's plate is the hours: the reading, the form and its cover sheet, the calls and the mail. The LLC's part is to confirm its details by email, choose any new address and sign.
As of October 30, 2026, our operator has filed 100 New York Certificates of Change since January 2026, all accepted by the State: the same filing a New York LLC uses to revoke its registered agent. The Our work page lists every one: the day filed, how it was filed, the day the State responded and the days between.

Remove Registered Agent's free record check
Remove Registered Agent reads your LLC's live State record for free, before anything is filed.
You enter your LLC's name or DOS ID in our record check. It shows the registered agent the State lists for your LLC, if any, and its service of process address, where the Secretary of State mails a copy of any process against the LLC that is served on the Secretary of State, then says what one Certificate of Change would change and what it costs.

Questions
How long does it take to cancel a registered agent in New York?
The New York Department of State publishes no standard processing time for a Certificate of Change, the filing that takes a registered agent off a New York LLC's record. How the certificate reaches the State is part of the time. The LLC's contract with the agent company runs on a separate clock, set by that company's own terms.
How long until a registered agent removal is final in New York?
No text in LLC Law §211-A or §302 sets a waiting period after an LLC files a certificate that revokes its registered agent; §302(e)'s thirty days run only from "the filing with the department of state of the certificate of resignation". By our count of New York DOS open data read on October 26, 2026, every one of the 22,845 Certificates of Change filed for New York LLCs and PLLCs from January 1 to October 19, 2026 carries an "Eff Date" equal to its "Date Filed", the 467 that revoked a registered agent included.
How do I know my registered agent removal went through?
The State's filing receipt confirms that the Certificate of Change was filed, and the LLC's live State record shows the revocation. Some agent companies' published terms ask for proof they are no longer listed as the LLC's registered agent; a filed Certificate of Change and the updated State record are that record. When Remove Registered Agent files the certificate, it checks the LLC's live record afterwards and sends the State's filing receipt and what changed.
Why does cancelling a registered agent take so long?
Cancelling a registered agent in New York is two steps, each on its own clock: a Certificate of Change filed with the New York Department of State, which publishes no standard processing time, and the LLC's contract with the agent company, which runs on that company's own terms. The State's own dates vary. By our count of New York DOS open data read on October 26, 2026, of the 467 Certificates of Change that revoked a New York LLC's registered agent from January 2 to October 13, 2026, 168 (36.0%) show the same "Approved Date" as "Date Filed", 36 (7.7%) show an "Approved Date" more than 30 days later, and the longest gap is 161 days. The data does not say why one certificate's dates sit further apart than another's.
Is there a faster way to remove a registered agent in New York?
The New York Department of State offers optional expedited handling for an additional, non-refundable fee. Its expedited handling page lists three windows, from "Within 24 hours of the request" to "Within 2 hours of receipt of the request", each with its own conditions, and says "The time for processing your request begins when the request is received by the appropriate unit of the Division of Corporations." and "For documents submitted for filing, such documents are considered processed when they are either filed or rejected as deficient." (read October 26, 2026). How the certificate is sent also counts. Remove Registered Agent's price does not include the Department of State's expedited handling.
Does a revoked registered agent stay on the record for 30 days?
In New York's LLC Law, the thirty days apply to a resignation: §302(e) says "The designation of a registered agent shall terminate thirty days after the filing with the department of state of the certificate of resignation." No text in LLC Law §211-A or §302 sets a waiting period after an LLC files a certificate that revokes its registered agent. A thirty-day rule that also counts from a revocation is in New York's Business Corporation Law, and it governs corporations, not LLCs. By our count of New York DOS open data read on October 26, 2026, all 467 Certificates of Change that revoked a New York LLC's registered agent from January 2 to October 13, 2026 carry an "Eff Date" equal to their "Date Filed".
Where does the State mail process while a registered agent removal is processed?
A designated service of process address continues until a certificate or other instrument directs mail to a different address (LLC Law §301(c)). For an LLC that is not suspended, when process is personally delivered to the Secretary of State, service on the LLC is complete at that point, and the Secretary of State then promptly sends a copy by certified mail, return receipt requested, to the post office address on file for that purpose (LLC Law §303(a)(1)). For an LLC suspended under §301-A, service through the Secretary of State follows LLC Law §301-A(e)(2). A registered agent company forwards process under its own contract with the LLC.
